Doctors can get very fed up because they make such small amounts for providing the reports and updates to insurance carriers. They are routinely asked to produce copies of their clinical notes and records and we see doctors becoming more and more irritated by the process. We help by stepping in and saying: Doctor, you only have to deal with us


And we will provide the updates to the insurer only as required. We will provide the information semi-annually or yearly, rather than weekly, for example. By negotiating this, we help the doctors who are then able to spend their time caring for the patient.


The doctor is the major supporter of the patient and really what the family doctor says is so persuasive to the claimant’s case. The family doctor sees the patient weekly and says this fellow is still having significant problems. That level of information is difficult for the insurer to overcome, although they will try to do so.


It’s critical that the claimant make regular visits to his doctor. Insurers look at those hospital and office visits closely. If someone is only seeing his doctor every six months, the insurer sees that the case is not a severe one.


It takes a team to make this work for our clients. One of the things that we do in our practice is to team up with the medical profession more and more. We are saying, look we are part of your patient treatment strategy and we should be talking a lot about how these claims are being handled and how they are being administered, so that everybody is on the same page. The doctor really has to be convinced, as well, that the lawyer representing his patient is competent to make the case for the patient because that will make a huge difference to the patient, in terms of the patient’s physical and mental welfare.


Because there is really only one major insurer, we see them sending people who claim benefits to the same group of experts, again and again. Reports from claimants say that these experts put a lot of pressure on them to admit that they are healthy and are only malingering and that they should just get back to work. This is why they need the support of their family doctor and experts that a lawyer can bring into the case, to protect their interests against the insurance carrier.
