Although the term personal injury is mostly associated with bodily injuries, it is not confined to that alone. In fact, the term is also used to describe the psychological effects that an accident has on an individual. This is why you often hear of victims seeking damages due to pain and suffering. Granted, there are quite a few frivolous lawsuits in this regard but, in many cases, accidents do affect a person's mental well-being.

In order for any instance to be considered a personal injury, it must occur due to the negligence or unreasonably unsafe actions of your employer, a manufacturer, your doctor, your landlord, or some other person or organization. If this is the case then you may be entitled to monetary compensation from the person or entity that caused the accident due to their negligent actions.

Now that you understand the facts, you must ensure that you gather the appropriate information about the accident to turn over to your attorney. Even in the midst of a personal injury you still need to try to remain calm enough to gather some very important information. If you are injured to the extent that you cannot gather the appropriate information then you will need to get someone to assist you in accomplishing this.

There are many things to consider when determining a dollar amount for which you are entitled based on your expenses and the time lost from work. This means that you need to have a good personal injury lawyer to monitor the insurance adjuster and facilitate the negotiation process. At the start of a claim negotiation, an insurance adjuster adds up the total medical expenses related to the injury. This is the base figure the adjuster will use to figure out how much to pay the injured person for pain, suffering, and other non monetary losses.

Once this base figure has been established, the amount can be multiplied by 1.5 all the way up to 10 depending on the severity of the injury. The actual compensation you lost due to missing work is then added, giving you your subtotal. Once that is determined, the adjuster will investigate if you have some culpability in the accident and what that percentage is. The percentage agreed upon will then be subtracted from the final amount leaving you with what your total compensation will be.
