When a wrongful death occurs, it can put tremendous stress on the surviving family members in more ways than one. Wrongful deaths occur thousands of times each year, leaving the surviving family looking for options and wondering what they can do.

What is a Wrongful Death?

A wrongful death is a death that results from the negligence of another party. Negligence is a legal term that is used to show who is responsible for the wrongful death. A party is negligent when their action or inactions differ from what a reasonable person would have done in the same situation. In order to obtain compensation, the families of wrongful death victims and their attorneys must prove that the death was the result of another party's negligence or malpractice.

Wrongful deaths can occur as a result of many different situations. Whether it is an auto accident, premises liability, medical malpractice , nursing home negligence, defective product, or dangerous drug, a wrongful death is something no family should be forced to deal with.

One of the most infamous wrongful death cases was that of civil suit filed against O.J. Simpson by the family of Ron Goldman, the friend of Simpson's murdered ex-wife, Nicole Brown Simpson, 1994. Though Simpson was found not guilty of the double murder in the criminal trial, he was found responsible for Goldman's death in the civil suit. Simpson was ordered to pay the Goldman's over $33 million in damages.

Families can be left in a state of confusion after a loved one is taken from them, especially if that loved one was the primary source of income or health befits for the family. A wrongful death suit can recover compensation for the family for their loved one's:

  • Future Wages
  • Hospital Bills
  • Funeral Expenses
  • Health Benefits
  • Pain
  • Suffering
  • Mental Anguish

If your loved one has been killed, and you believe it is the result of a wrongful death in West Virginia or Ohio, it is important that you contact an experienced wrongful death lawyer as soon as possible. The law limits the amount of time you have to file you wrongful death claim, and while a lawsuit is often the last thing on a grieving family's mind, it is often one of the most important actions to take.
