During the age we live in, we receive a great amount of information with a few mouse clicks. The immediate demand is cherished and desired in other aspects of our lives. Many couples going through divorce, do not want to prolong the process. It is difficult to deny the fact that both parties are aware of the difficult times in each of their life. Both spouses don't want to go through hours of litigation to resolve problems. The sooner the better is the case most of the time. Legally, what is the best divorce in the essence of time and money?  This answer is an uncontested divorce.  Where both parties come together and reach agreements on major issues related to their divorce, is called an uncontested divorce. Uncontested divorces do have pros and cons, but is not for everyone.
One of the major benefits of an uncontested divorce is a lesser expense. Most clients do not want to spend all their life savings (or most of it) on a divorce. Many spouses falling into a dissolution will want to save as much as they can. With the uncontested divorce procedure, couples may agree on the main controversies of divorce including childcare, division of property, wills and estates, without takling the case to trial. Clients are allowed to file dissolution complaints without a present lawyer, but the spouse should be cautious of legal consequences as advisement from a professional is always better.
When children are considered, the courts review the spouses current status and living conditions, then decide which spouse is best for the care of the children. They will also consider if child support will be paid and amount.  An uncontested divorce is best suited for a couple that is able to work out their discrepencies and work out a compromise.
Not everyone is well suited for an uncontested divorce. Of course, if a couple can not agree on certain matters, the option will not suit the situation. If one spouse will not say a word to the other spouse, then both parties coming to an agreement is going to be difficult. A contested divorce would work better in these examples as all money that was issued towards the uncontested divorce is now lost.
In circumstances where one partner has a much better understanding of the law and the legal consequences, an uncontested divorce would be improper. Unjust fields, as indicated above, give one side an unfair advantage in the solution. Also, if one spouse has an excessive desirable outcome and is not reasonable, uncontested procedures will not work. If an equitable agreement can be reached and one spouse is more demanding, once again the money will be lost and contested divorce must be taken into account.
In addition, if one spouse has been a victim of violence or domestic violence played a role in the dissolution of marriage, an uncontested divorce should not be considered. Domestic violence can create uneasiness and fright to an abused spouse. These factors create a fearful attitude and the agreements will not be achieved.
Uncontested divorces is one of the fastest ways to dissolve a marriage. It has its advantages in putting the two parties to work out and resolve their disputes. Uncontensted divorces are not best suited for cases dealing with abused victims, a greedy spouse, an uncooperative spouse or a spouse with a better understanding of the law. For best results, one should always seek legal help from a lawyer that has dedicated his or her practice in the family law field.
